Mediation fees are charged on the basis of a flat fee per party for each mediation day.  A typical full day mediation begins at 9:30 a.m., includes a working lunch and continues until 5:30 p.m.  A typical one-half (½) day mediation begins at either at 9:30 a.m. or 1:30 p.m. lasting four (4) hours.  Most sessions conclude within the time periods described above, however, sometimes a session requires more than the allotted time, in which event, additional mediation fees shall be assessed to each party at the rate of $125.00/party/hour until the session is concluded.

            The mediation fee is due when the Mediator’s Confirmation letter is sent to you.  If you cancel a confirmed session, please refer to the Rule 19 cancellation provisions on the accompanying Rules for Mediation.

            If the parties initially request that more than one successive mediation day be scheduled, then the full fee for all scheduled sessions is due and earned upon the commencement of the first day of mediation.

            The daily fee includes:

·         Scheduling and administering the session(s)

·         Any pre-mediation attorney conferences

·         Conducting the mediation session

·         Post-session telephone facilitation when appropriate

·         Lunch and refreshments

            The process of mediation contemplates all parties share in the payment of the mediation fee.  The fee varies with the “amount of controversy” (the aggregate amount of all claims for affirmative relief, excluding attorneys’ fees and court costs) and the number of “parties” for purposes of the mediation fee.  All parties represented by the same attorney or law firm are usually considered a single “party” for purposes of the mediation fee.  Fees will be adjusted upward when the parties decrease in number by the time of mediation.

*Certain large and/or complex cases or other special circumstances may dictate a higher fee as agreed between the mediator and the parties.  Reduced fees may likewise be considered in special circumstances.  Fees are subject to change.
